LAW Weekly Roundup 10-16 May 2001

17 Palestinian killed; 5 in one attack Israeli forces use gunship and excessive force against civilians during Al Nakba commemorations 10-year-old boy detained in Beit El Introduction: The current Intifada has now been raging for 32 weeks, with no sign of an end to the military aggression and dangerous escalations of the Israeli army, which in the past week alone has used land-land, sea-land and air-land missiles, tanks and heavy artillery for shelling Palestinian security posts and civilian houses. In addition, there has been a great deal of trespassing into PA-controlled territory, bulldozing wide swathes of agricultural land and demolishing houses. The gravest Israeli assaults this week were in the Gaza Strip, affecting Gaza City, Deir Al Balah, Rafah, Beit Lahai and Al Qarara village. At 11am on 12 May 2001, Israeli helicopters fired four missiles onto a Palestinian civilian car on the road adjacent to Jenin’s Ministry of Interior, targeting a Fateh activist and two Palestinian General Intelligence officers, also killing a traffic police officer who was in a car nearby. Furthermore, at dawn on Monday 14 May, Israeli forces killed five Palestinian National Security Force members at Bitunia checkpoint, although no clashes were taking place. This week, Israeli soldiers have continued their excessive use of force against Palestinian civilians, particularly on Tuesday 15 May 2001, the 53rd anniversary of Al Nakba. Israel responded with excessive and lethal force to Palestinian civilians involved in peaceful demonstrators commemorating Al Nakba. During the demonstrations three Palestinians were killed and about 300 were injured. The day before, Israeli forces opened random indiscriminate fire at a row of Palestinian cars as civilians awaited permission to cross Al Matahen checkpoint at Salah Iddeen Street, north Al Qarara village in the Gaza Strip. The incident was triggered when a lone Palestinian threw a hand grenade at an Israeli military watchtower. He was killed instantly, along with the driver of the service taxi behind him, and seven others were injured. In the past week, 17 Palestinians have been killed, including 5 children, 5 Palestinian police officers and 7 others in various circumstances: 1. 16 –year-old Husam Tafesh from Al Zaytoun quarter in Gaza was shot in the right waist. 2. 28-year-old Mu’tasem Al Sabbagh a Fateh leader from Jenin, received shrapnel wounds in the head (lacerating his brain), chest, abdomen, pelvis and right thigh. 3. 26-year-old Allam Al Jaloudi, a staff sergeant from Faqu’ah village, received shrapnel in the head. 4. 26-year-old Ahmad Zaqout, from Al Nsirat refugee camp. 5. 31-year-old Salah Abu Amra, from Rafah. 6. 21-year-old Muhammad Daoud, from Al Breij refugee camp. 7. 22-year-old Ahmad Abu Mustafa, from Khan Younis. 8. 18-year-old Muhammad Al Khaldi from Al Breij refugee camp. 9. 26-year-old Muhammad Al Qassas from Gaza. 10. 28-year-old Arafat Abu Kweik from Al Shate’ refugee camp. 11. 35-year-old Abdel Hakeem Mana’meh from Jabalia, shrapnel in various parts of the body. 12. 22-year-old Burhan Al Shakhsheer from Al Ram, north Jerusalem, was hit by a live bullet that penetrated his neck and settled in his head. 13. 17-year-old Muhammad Abu Jaser from Jabalia refugee camp received a live bullet in the heart. 14. 14-year-old Muhammad Isleem from Al Breij received a live bullet in the back. 15. 45-year-old Suleiman Al I’rouqi, shrapnel in the head. 16. 17-year-old Kifah Za’rab from Al Mawasi in Khan Younis was prevented from crossing an Israeli checkpoint to reach hospital. At around 7pm on Thursday 11 May 2001, Israeli soldiers opened fire at a Palestinian civilian car on the Ramallah-Jerusalem road after it had crossed the Israeli checkpoint near Qalandia Airport and covered 200m of Qalandia refugee camp. 35-year-old Samar Jweehan from Al Thori in Jerusalem stated to LAW that she, her 42-year-old husband Zidan Jweehan and their children Muhammad (13), Alia (12), Hiba (4½) and Sanad (1½) were in a private red Citroen. She said, “After we crossed the Israeli checkpoint, I heard shooting and saw a flash that hit the window next to my husband and smashed the glass. The children started screaming and we drove towards the Palestinian National Security Forces checkpoint at the northern entrance to Al Bireh. One of them inspected the car but didn’t find the object that had hit us. Zidan Jweehan stated that Israeli soldiers stationed at the military checkpoint at Qalandia Airport, shot at the car from a distance of 100m. He added that an hour later he found a number of Israeli soldiers there, so he questioned them about the reason for shooting at his car. They responded that they only shoot at stone throwers, but one of them shouted, “Why do you throw stones at military posts?” When Zidan reached Al Ram checkpoint the soldiers there took him to Neve Ya’qoub Police Station, where he was told to go to the Russian Detention Center if he wished to register a complaint. On Saturday 12 May, Zidan complained and an expert inspected his car, before informing him that the glass had been smashed by a stone and not a bullet. He does not accept this claim as the car was hit from the side of the Israeli military point. Furthermore, interrogators refused to speak to him in English or Arabic but insisted on doing it in Hebrew. At 11:30 am on Saturday 12 May, two helicopters fired four missiles at a Palestinian vehicle traveling near the Ministry of Interior in Jenin, targeting a Fatah activist and two Palestinian general intelligence officers. Mutasim Al Sabagh and a transport police officer died in the attack. LAW Society’s field researcher stated that just before 11:30 am, four Israeli Apache gunships were hovering over Jenin. Two of them, flying over the northern part of the town, sent down four missiles onto a car in which three Palestinians were traveling. The three had seen the Israeli gunship before the missiles were fired and they left the vehicle promptly. 28-year-old Mutasim Al Sabagh, a Fatah activist from Jenin refugee camp, did not manage to escape and was hit in the head, chest, abdomen, right leg and hand by shrapnel. He was admitted to Rafidia hospital in Nablus where he died of his injuries. Abdul Kareem Awees, 27, and Yusif Al Kisi, 26, both Palestinian general intelligence officers also from Jenin refugee camp, were wounded but survived, although the offensive also killed 26-year-old Alam Al Jaludi, a Palestinian police officer from Faku’a, who died instantly after being hit in the head by shrapnel and Tareq Al Haj, 32, from Jalqamus in Jenin, after being hit by shrapnel in the chin, right ear and neck and burns in all parts of the body. In addition, two others were wounded: · Munther Abu Al Rub, 43, from Qibatia, shrapnel in the head. · Muhammad Al Sumudi, 18, from Jenin, shrapnel in the head while lying down on bed inside his bedroom since shrapnel entered the window and hit him in the head. According to Tareq Al Haj’s affidavit to LAW, at around 11:30am that day he was on routine patrol, sitting in the front of the police car near the driver, Nasri Al Jaludi. As they passed the main street between Al Zahra’ School and the Education Department, a loud explosion was heard, apparently from the garden of the Dr. Jameel building. He added: “I saw a piece of metal 4 inches wide and 15cm long entering the front left window. It hit Nasri in the neck and head, and he shouted out in pain. Another piece of shrapnel of about the same size hit my left leg. Nihayah Al Qarout stated to LAW that at around 11:30am that day, while she was at home in Al Zahra’ quarter (opposite the Ministry of Education), she heard three explosions. She rushed screaming with panic into the bedroom of her daughter, 3-year-old Siba, then opened the northwest door intending to go out in the street, to see a car that was burning 50m from her home. At the door was a boy, covered in blood, who she recognized as Abdel Karim Abu Weis, so she let him in until an ambulance arrived 15 minutes later. As a result of this aggression, many houses were damaged: · Dr. Jameel’s 4-storey residential building, which housed 8 families (total 37 inhabitants), including 18 children. The walls were cracked and windows smashed, and the 22m long 1.5 high wall around the building was demolished. · Muhammad Jarrar’s house (5 inhabitants). The windows of the children’s and other bedrooms were smashed. · Jamal Al Qarout’s house (4 inhabitants). 9 windows were smashed and a wooden door was destroyed. · Suhad Al Ahmad’s house, damaged doors and cracks in walls. · Ahmad Jarrar’s Rent A Car Bureau, windows smashed and doorway damaged. At 9pm on Sunday 13 May 2001, Israeli border police opened fire at a private car at the road between Silwan and Al Sawahreh in Jerusalem, hitting 36-year-old Al Quds Press reporter, Iman Masarweh, with gunshot that penetrated her right leg. According to Iman’s affidavit to LAW, she and some relatives were in a red Chevrolet on their way to Bethany in Jerusalem to visit relatives. They used a bypass route (Al Sal’a road) that links Silwan to Al Sawahreh. When they came across an Israeli checkpoint they decided to avoid it to save time, so they turned around. Police opened fire from a distance of 100m, firing four bullets at the car and hitting Iman in the left shin, fracturing her bone and causing a deep flesh wound. The police opened fire unjustifiably and without prior warning, and it is worth noting that no clashes were taking place at that time. In the early hours of Monday morning, Israeli soldiers killed five members of the Palestinian National Security Forces (NSF) in southern Beitunya, near Ramallah. According to LAW's documentation, soldiers stationed on the roof of an under-construction Palestinian building that was occupied forty days ago by the Israeli army, along with soldiers in another Israeli outpost on a hilltop 200 metres from the NSF barrier, opened fire on 6 NSF members guarding the southern entrance to Beitunya, killing five, two of whom had been preparing a meal inside their makeshift tin room. (100 metres from the barrier) at the time of the assault. The five Palestinians killed were: 1. 26-year-old Ahmad Zakut from Al Nsirat refugee camp in the Gaza Strip 2. 31-year-old Salah Abu Amra from Rafah in the Gaza Strip 3. 21-year-old Mohammad Dawood from Al Braij refugee camp in the Gaza Strip 4. 22-year-old Ahmad Abu Mustafa from Khan Younis in the Gaza Strip 5. 18-year-old Mohammad Al Khaldi from Al Braij refugee camp, Gaza Strip. An eyewitness who lives nearby told LAW that he saw three of the six policemen dead inside their tin shelter after he heard shooting at 2:00 am. They were covered with the food they had been preparing before they were killed. The body of another policeman was outside the room, a fifth was wounded but still alive and the sixth was unharmed. The eyewitness called an ambulance and collected the weapons of the Palestinian policemen, which he stated were not prepared for shooting. Another NSF officer, quoting the policeman who escaped the Israeli assault, stated that they had been taken by surprise when Israeli soldiers fired at them from the nearby rooftop and hill. He added that the shooting went on for three minutes, and that he had only escaped death because he fell in a trench while trying to save his colleague. Palestinian medical sources at Ramallah hospital stated that the five policemen had been shot several times by M16s in the upper parts of their bodies. Following the massacre, Israeli politicians confessed that a ‘mistake’ had occurred. On Wednesday 16 May 2001, the French news agency A.F.P reported the Israeli Foreign Minister, Shimon Peres, as saying: “I’m very sorry for the death of the five Palestinian policemen,” and broadcasted the statement of another Israeli official that the five Palestinian security forces had died as a result of incorrect data being given to the soldiers responsible for the operation. He added, “The soldiers thought they were attacking a 17-Force headquarters.” At 2pm that day, Israeli soldiers stationed at the border with Egypt, south Rafah, shot 11-year-old Ziyad Sha’ath, who was carrying a plastic toy rifle, with a live bullet in the back. At around 4:45pm, two civilians were killed - Muhammad Al Qassas, 26, from Gaza and Arafat Abu Kweik, 28, from Al Shate’ refugee camp - after Israeli forces at Al Matahen junction, north of Al Qarara village in Khan Younis, opened fire at Palestinian civilians and cars on their way from Khan Younis to Gaza, waiting for a pass-permission, and this led to various injury of seven as well. According to information gathered from Gaza by LAW, a queue of Palestinian civilian cars were waiting at Al Matahen junction checkpoint for permission to cross. A 28-year-old Palestinian, Arafat Abu Kweik from Al Shate’ refugee camp, left his car and threw a hand grenade at an Israeli military watchtower. It hit the tower’s fences and fell to the ground. He took another grenade and tried to throw it, at which point the soldiers stationed on the tower shot him and killed him at once. Several others in the row of traffic left their to seek shelter, but the soldiers continued spraying random indiscriminate gunfire at the row of cars for more than 10 minutes although the thrower of the grenade had been killed in just a few seconds. As a result, 26-year-old Muhammad Al Qassas, the driver of the car behind Abu Kweik’s, was killed after being shot in the head, abdomen, right hand and left leg. Seven others were injured: 1. Rawhi Al Hor, 45, from Khan Younis, gunshot in the pelvis. (Critical injury). 2. Ahmad Al Shaweesh, 20, from Gaza, shrapnel in the head and right shoulder, and shrapnel in the right hand. 3. Al Qassas and the other wounded were left bleeding inside their cars for 30 minutes without the Israeli forces aiding them or allowing Palestinian ambulances to reach them. They held Abu Kweik’s body for more than 2 hours before handing it to Palestinian Military Liaison. On Tuesday 15 May 2001, the Palestinian people commemorated the 53rd anniversary of Al Nakba, the 1948 Palestinian catastrophe when hundreds of thousands of people were evacuated and uprooted from their homeland to make way for the establishment of the state of Israel. The Palestinian people marked this painful anniversary by means of peaceful demonstrations in towns and villages across the country, in an attempt to remind the world of their suffering. That morning, 35-year-old Abdil Hakeem Al Mana'meh from the Amer Housing Project in Beit Lahia, Gaza, was killed after Israeli soldiers opened fire at a Palestinian civilian car.. During the Nakba day demonstrations, the Israeli army responded with excessive force, in most cases opening heavy and random gunfire against unarmed protesters. At around midday of that day, Israeli soldiers positioned at the northern entrance of Al Bireh and on the roofs of nearby houses, opened live fire at Palestinian demonstrators. Following clashes between demonstrators and Israeli soldiers, Israeli forces fired ammunition and 500-800 mm artillery shells at demonstrators and buildings in Al Balu' quarter, leaving two dead: · 18-year-old Abdel Jawad Khalil Shihada, a Ramallah Military Intelligence Apparatus member from Al Sheikh Radwan quarter in Gaza, was hit in the head by a fragmenting bullet. At around 11 am, Israeli forces attempted to break into the village of Hares, near Salfit. Abdel Rahim Souf from Hares telephoned his 31-year-old brother Issa Souf and asked him to round up the village children and get them safely inside. As he was doing this, carrying his three-year-old nephew, he was confronted by Israeli soldiers and an argument broke out. He turned away from the soldiers, still carrying his nephew, and they opened live fire, hitting hit him in the right shoulder. The bullet penetrated his right lung and settled in his backbone. He had his mobile telephone in his hand at the time of being shot, and pressed the 'redial' button that would connect him again with his brother, Abdel Rahim. He managed to tell him that he had been shot. Abdel Rahim rushed to the scene, but the soldiers prevented him from reaching Issa and fired a stun grenade at him. Their other brother arrived and was also prevented from reaching Issa. It was only 30 minutes later, due to the intervention of the Palestinian Liaison office, that he was finally allowed to be taken in a private car to the nearby Kuful Hares clinic, where an ambulance arrived 20 minutes after that. Souf was transferred to Rafidia Hospital in Nablus, where medical sources have informed LAW that the bullet in his spine has resulted in permanent paralysis.
