Please sign the petition and also go to his web-page which we have recently finished. here you will find all the necessarry information about his case - also the legal documents in his case. This man was dragged to court while he was seriously sick after he had been shot by the Houston police SWAT team. Right before the trial he was through two surgicals. His testinies had been blowned up and he got a colostomy. During his trial he had several times complications with his colostomy, infections in the gunshot wound, pneumonia, he lost 1/4 part of his normal body weight, had fever, chills etc. Some days he was brought to trial in a wheel chair because he was too weak to stand on his own feet. Other days he was too weak to even speak in an audible voice. But nothing could stop the State of Texas to continue the trial.He was not competent to even communicate with his lawyer.(on this web-page you can find the affidavit of one of his trial attorneys who can confirme this, pluss an affidavit from a medical expert who also says that Thomas was not competent to stand trial at all) The prosecutors in his case, two of them had been found in different courts not long time before Thomas' trial to have used racial discriminatory tecniques in the jury selection - nearly identical to the tecniques they used in the jury selection in Thomas' trial. They used ten of their fourteen peremptory challenges to exclude African American jurors.( Thomas is African American) In his trial there were three white prosecutors, a white judge, a white jury except for one black - this man was only allowed to be in the jury becuase he stated that execution was a too mild sentence, he meant that somebody like Thomas should be slowly tortured to death. Thomas is African American and so were his two court appointed attornies. How can this be justice? I have known Thomas for ten years and have been in Texas six times and visited him. This man is innocent and he had witnesses who could have witnessed that Thomas was in Houston when the murder occured and not in Irwing. But these witnesses were never heard by the court. Thomas has received a scheduled execution date scheduled on February 21, 2002 and has already been in a death watch cell for a while. He has witnessed through his small cell window that two men has been brought into the dark death van to drive them to the Walls Unit where they have been executed. It was Jeffery Tucker and Emerson Rudd. Rudd was gassed and shackled before the guards loaded him on the floor of the van. The prison administration and the officers at Polunsky Unit is breaking human rights on a daily basis. The conditions becomes more and more inhumane and horrible. They do all they can to break down the inmates and torture them in all imaginable ways before they execute them. As Thomas says, the conditions are so bad now that death will be a release. Now they also have to send out their properties because they are only allowed to have property which fills two bags. The prison adminiatration says it is security. How can books , photoes, letters etc. be a security matter. The thing is that it makes it easier for the guards to trash the inmates cells which they do quite frequently.
