Welcome

to

Magistratura Indipendente’s website

Welcome to Magistratura Indipendente’s website Magistratura Indipendente is an Association of Italian judges and public prosecutors. It acts within the international organisations of the judiciary as well as a member of the Associazione Nazionale Magistrati. The main aim of MI is to safeguard the freedom and independence of the judiciary as established by the Italian Constitution. All members of MI uphold these two constitutional principles are essential to the proper functioning of justice, and not as privileges accorded to judges or prosecutors on a personal basis. In this perspective, Magistratura Indipendente is concerned with preserving the dignity and unity of the judiciary, never acting in accordance to the interests of political parties. The essential character of those judges who join MI is their impartiality. They must be completely free from any political influence in their judicial, social and private activities. At the same time they must be in touch with those issues affecting private citizens, society in its various aspects, political parties and lawyers, giving them all full and equal respect without fear or favour. The debate within Magistratura Indipendente is constantly aimed at updating the members’ cultural background and ideals, both from an Italian and an international perspective. For this reason MI promotes and encourages an open discussion, in which non-members can participate, in the firm belief that justice is not best served by corporative-thinking judges. In order to guarantee people’s rights and achieve equality before the law, MI’s basic commitments are: · to improve the professional standard of judges and public prosecutors from the viewpoint of their technical knowledge as well as that of their ethical behaviour, both during trials and in their daily lives; · to enhance their ability to cope with new European and international prospects and with the modern issues of international co-operation; · to reflect thoroughly about the increasing role of justices of the peace; · to improve the effectiveness of the judicial system and the enforcement of justice. *
