Un ricordo di un grande scienziato
Astronomo, scrittore e vincitore del Premio Pulitzer

Carl Edward Sagan è stato uno dei maggiori astrofisici degli ultimi decenni, docente di astronomia alla Cornell University, grande divulgatore scientifico, fondatore della Planetary Society, consulente della NASA per le missioni Mariner, Voyager e Viking, ideatore del progetto S.E.T.I. (Search For Extraterrestrial Intelligence), nonché autore di oltre trenta libri tra cui "Contact" dal quale è stato realizzato l'omonimo e noto film di fantascienza (attrice protagonista Jodie Foster) diretto da R.Zemeckis.

Questo libro, nato sulla scia di una famosa serie televisiva The Cosmos(tra le più seguite nella storia della Tv statunitense) che ha entusiasmato gli spettatori americani e poi quelli italiani, consente di scoprire le bellezze del cosmo attraverso un linguaggio semplice ed affascinante.

Un libro importante !

"Il Mondo infestato dai demoni" di Carl Sagan
Sottotitolo: La scienza e il nuovo oscurantismo

L'opera ultima di Carl Sagan, il suo testamento spirituale contro l'oscurantismo scientifico, contro tutte quelle cose che portano l'uomo lontano dalla ricerca della verità e soprattutto contro l'irrazionalità, la superstizione ed il pregiudizio che non possono certo essere le solide basi su cui appoggiare il XXI° Secolo. 535 pagine che ho divorato in meno di una settimana e che anche ad uno scettico come me che si sempre ritenuto di grande apertura mentale, ha saputo ampliare gli orizzonti oltre i 360°! Hanno scritto di questo libro:
"Quando leggo, ho l'abitudine di sottolineare i passi più belli. Ma con questo libro ho desistito : avrei consumato troppo inchiostro" Richard Dawkings, The Times. Giornali settimanali, radio e televisioni dedicano ampio spazio a presunti fenomeni paranormali, a guaritori, ad astrologi, a pratiche mediche cosiddette alternative, trattando tutto ciò in modo acritico, senza alcun criterio di controllo; anzi cercando, il più delle volte, l'avvenimento sensazionale che permetta di alzare l'indice di vendita o di ascolto.
Noi riteniamo che ciò sia profondamente diseducativo e contribuisca non solo a incoraggiare la già diffusa tendenza all'irrazionalità, ma anche a dare credibilità a individui che traggono profitto da questa situazione.
Portiamo, dunque, avanti un'opera d'informazione ed educazione rispetto a questi temi, per favorire la diffusione di una cultura e di una mentalità aperta e critica e del metodo razionale e scientifico nell'analisi e nella soluzione di problemi. Sollecitiamo un'attenzione e un impegno particolari verso i nostri obiettivi da parte di scienziati, intellettuali e di tutti coloro che, come gli insegnanti, stimolano e influenzano la vita culturale del Paese.
L'opera del Comitato non è isolata ma si riallaccia ad azioni e obiettivi di movimenti analoghi, che si sono sviluppati negli ultimi 25 anni in oltre 80 paesi di ogni continente.

Abuso della credulità popolare: art. 661 c.p.
Risponde di tale reato colui che, pubblicamente, cerca con qualsiasi impostura, anche gratuitamente, di abusare della credulità popolare, se dal fatto può derivare un turbamento dell’ordine pubblico. Impostura è ogni atteggiamento malizioso diretto ad ingannare e idoneo allo scopo in relazione al soggetto verso cui si esplica. La contravvenzione esige il dolo. Il fatto deve avvenire pubblicamente e deve poter causare un turbamento dell’ordine pubblico (non occorre, però, che tale turbamento si verifichi effettivamente).
Pena: Arresto fino a 3 mesi o ammenda fino a lire 2.000.000.
Istituti processuali: competenza: Tribunale monocratico. Sono applicabili le sanzioni sostitutive previste dagli articoli 53 e successivi della legge 689 del 1981 oblabili ex art. 162bis c.p. (invece l'illecito di ciarlataneria è invece depenalizzato ex art. 33 legge 689 del 1981, con riferimento all'art. 121 t.u.p.s.)
(Ad esempio maghi che pubblicizzano le proprie capacità attraverso le inserzioni pubblicitarie; moltissimi casi di pubblicità ingannevoli sospese dall'IAP e dall'Antitrust perché contrarie alle norme che disciplinano la pubblicità).

 

Abusivo esercizio di una professione: art. 348 c.p.
Risponde di tale reato chiunque esercita abusivamente una professione per la quale è richiesta una speciale abilitazione dello Stato.
Scopo della norma è la tutela del normale funzionamento della Pubblica amministrazione, che esige che determinate professioni siano esercitate solo da chi sia in possesso di speciale abilitazione amministrativa, rilasciata per garantire i cittadini in ordine alla sussistenza dei requisiti di idoneità e di capacità di colui che l’esercita.
Perché si abbia esercizio abusivo della professione è sufficiente il compimento di un solo atto purché rilevante in sé o per le conseguenze che possano derivarne. L’esercizio è abusivo anche quando il soggetto sia decaduto dalla relativa abilitazione o ne sia stato sospeso.
Pena: Reclusione fino a 6 mesi o multa da lire 200.000 a 1.000.000.
Istituti processuali: competenza: Tribunale monocratico; procedibilità: ufficio; arresto: non consentito; fermo: non consentito.

 

Truffa: art. 640 c.p.
Commette tale delitto chiunque, con artifici o raggiri, inducendo taluno in errore, procura a sé o ad altri un ingiusto profitto con altrui danno.
La condotta dell’agente si concretizza nei cd. artifici o raggiri. Con l’artificio l’agente fa apparire come vera una situazione che è invece ingannevole; con il raggiro l’agente si avvale di ogni affermazione mendace detta in modo da convincere e sorprendere l’altrui buona fede.
È necessario che artifici e raggiri abbiano indotto in errore la persona (si avrebbe altrimenti solo una tentata truffa): sussiste tale requisito quando la vittima sia divenuta certa dell’esistenza di una situazione che in realtà non esiste.
Il soggetto in errore deve poi, come conseguenza dell’inganno, aver compiuto un atto di disposizione patrimoniale: tale elemento non è espressamente previsto dalla norma, ma supposto implicitamente.
Tale atto produce un danno patrimoniale nei confronti della vittima.
Deve infine sussistere l’ingiusto profitto per l’ingannatore o per altri.
Il profitto è ingiusto quando il vantaggio non è né direttamente né indirettamente tutelato dall’ordinamento.
La truffa è aggravata se commessa a danno dello Stato o di altro ente pubblico, o col pretesto di far esonerare qualcuno dal servizio militare, oppure ingenerando nella persona offesa il timore di un pericolo immaginario o l’erroneo convincimento di dover eseguire un ordine dell’autorità.
Pena: Reclusione da 6 mesi a 3 anni e multa da 100.000 a 2 milioni di lire; se la truffa è aggravata (art. 6402 c.p.) la pena è della reclusione da 1 a 5 anni e della multa da 600.000 a 3 milioni di lire.
Istituti processuali: competenza: Tribunale monocratico; procedibilità: querela, se non ricorra alcuna delle circostanze di cui al 2° comma; arresto: facoltativo; fermo: non consentito.

Il reato di truffa (che spesso ricorre) è più difficile da dimostrare ed è procedibile solo a querela di parte (art. 640 cod. pen. - reclusione da sei mesi a tre anni e multa da lire centomila - competenza del Pretore).
In tutti questi casi, il locale, ove viene svolta l'attività illecita può essere sequestrato e devono essere apposti i sigilli. Inoltre, le somme corrisposte dalle vittime-clienti devono essere sequestrate e restituite.
L'eventuale denuncia deve avvenire con un esposto (querela in caso di truffa) indirizzato al Procuratore della Repubblica presso la Pretura della propria città.
Se venisse avviato un procedimento penale e tale procedimento dovesse dar luogo ad una assoluzione i "maghi" potrebbero immediatamente essere contravvenzionati ai sensi dell'art. 1 comma ultimo, legge 516 del 1982 - "omessa tenuta delle scritture contabili" e denunciati per l'omesso versamento dell'IVA e dell'IRPEF sui redditi degli ultimi cinque anni, compresa una sanzione del 100% sulle somme non versate all'erario.
Tutta la giurisprudenza esistente fino ad oggi è a favore dei maghi (tutti assolti) ad eccezione di quelli che si fregiavano del titolo di "dottore", o eventualmente per quelli che hanno commesso il reato di "truffa" magari affiancato con il reato di "abuso sessuale" ed altro.
Ma va precisato che la giurisprudenza esistente non fa testo in considerazione del bassissimo numero di denunce presentate negli ultimi anni.
