Conctract for the Agency

 
 
SPECIMEN OF OUR CONTRACT

1. VENICE HOLIDAY'S grants the Agency the right to publish and divulge information on its properties on the market in order to establish a working partnership in the tourism sector. This authorisation does not infer any exclusive right and does not involve any cost for VENICE HOLIDAY'S.

2.  VENICE HOLIDAY'S grants a 15% commission on the selling price of the holidays confirmed by the Agency. The Agency will deduct this percentage directly from the gross price before remitting the residual payment. 
The terms of payment are the following: 30% on booking of the holiday; the remaining 70% must be paid at least 60 days before using the property. If the balance is not received by VENICE HOLIDAY'S by the due date, VENICE HOLIDAY'S shall be entitled to cancel the booking, without giving back the entire amount of the booking deposit.
We accept payments by credit card or wire transfer. Our bank details are: Banca Antoniana Popolare Veneta, Branch of Venice, c.a. 109195, foreigner swift ANTIB-IT-2P ABI 05040, CAB 2005.
Upon receiving payment in full, VENICE HOLIDAY'S will send a voucher for the customer.
The Agency requests a stay to VENICE HOLIDAY'S at least two months before the use of the property and confirms it within the tenth day following the date of request. After this period, VENICE HOLIDAY'S is free to assign the properties to other Agencies.
It is understood that this contract satisfies transitory housing needs only and that the contract automatically expires at the end of the rental period. Neglect to vacate the rental property within its leased term will automatically result in a daily fine of Lire 200.000 per day, in addition to the rental price of the staying.
VENICE HOLIDAY'S offers bonuses to the Agency for achieving the following results: from 50 to 150 nights per year, a bonus of 5%; from 150 to 300 per year, a bonus of 10%; more than 300 nights per year, a bonus of 15%. These bonuses will be paid to the Agency upon reaching each of the targets.
The prices set by VENICE HOLIDAY'S in Italian lire are fixed and will not be modified until  December, 31 2000.

3. Cancellation fees: 
60 days or more before the beginning of the rental period: 20% of the gross price; 
within 59 days before the beginning of the rental period: 80% of the gross price.
Penalties are applied only if VENICE HOLIDAY'S has received part or full payment.
Cancellation must be received by us in writing (fax:+390412757028).
If the customer or the Agency change the dates already confirmed, this becomes a new rental. The booking deposit is subject to the cancellation condition as in this paragraph.

4. VENICE HOLIDAY'S grants that the property is free from people and things, is perfectly clean and tidy, and that all systems, fittings, furniture, kitchenware and electrical appliances are in regular working order.
In the event where a property is no longer available due to unforeseen circumstances, VENICE HOLIDAY'S will look for another property with similar characteristics; if such a property is not found, the customer will receive a full refund of the amount paid. 

5.  VENICE HOLIDAY'S is willing to help the Agency with any information on the availability of the properties or bookings, and for any clarification required on other services, either by e-mail veniceholidays@tiscalinet.it, telephone +390412750689 or fax +390412757028.

6.  At least 30 days before the departure date and in any case upon receipt of the full payment, the Agency will be sent some necessary and useful information for the customer, that is: the complete address of the property; the details of the person or the agency who will greet the customers upon their arrival; the name and the telephone number of the person to contact in case of necessity; an inventory of the furniture, the valuable objects and the electrical appliances; the dimensions of the apartment, the number of rooms, bathrooms and beds. The Agency must let the customer know the general rules of bookings as they are written on Venice Holiday's web site, under the title "General Conditions".

7. VENICE HOLIDAY'S is not responsible for any damage or theft, direct or indirect injuries or for any other inconvenience suffered by the customers during their holiday. 

8. Only those persons listed by the Agency may use the property. The number of people must not exceed the number of sleeping places indicated in the property listing except in the case of infants (under two years) for whom the customer brings a travelling cot and linen. Pets are not permitted unless explicitly agreed to in writing. Should VENICE HOLIDAY'S find any violations to this clause, it is totally up to its discretion to ask the customer to vacate the house.

9. The price of the property includes the costs of electricity, heating, cleaning, taxes and duties of any kind, with the exception of telephone calls, that are to be paid by the customer. In the rental price is also included the welcome and transportation from the airport of Venice to the flat. If there are other utilities included in the price, they are written on the property list on Venice Holiday's web site.

10. The customer must arrive between 4pm and 7pm on the first day of the stay, and leave before 10am on the last day of the stay.

11. Security deposits are due on every property. The amount of each deposit will be specified on the confirmation of the property the Agency chose. The security deposit covers the cost of any damage or breakage during the customer's stay to the property and its contents, inside and outside, excluding normal wear. Judgement as to the condition of the property  is left to the sole discretion of VENICE HOLIDAY'S. This amount less any applicable claims, will be returned to the customer the day of their departure from the property.

12. The descriptions in the listing are made in good faith. VENICE HOLIDAY'S however, declines responsibility for any modifications made by the owners without our knowledge. If during the stay, not solvable problems should arise, the customer should contact VENICE HOLIDAY'S immediately. Our agency must be notified in writing (fax +390412757028, e-mail veniceholidays@tiscalinet.it) within 48 hours of the occurrence giving rise to the claim. Complaints lodged at the end of the rental period will not be taken into consideration. No refunds will be paid due to temporary interruptions in the electricity, gas and heating systems, or due to sudden damage either inside or outside the property. VENICE HOLIDAY'S will operate immediately to repair the damage or have the damage repaired.
Should the customer abandon the property without authorisation by VENICE HOLIDAY'S, he will lose all rights to compensation.

13. The person signing the booking form of the Agency is responsible for the correct and decent behaviour of his/her party. Should the person and his/her party behave in such a manner that is not acceptable by civilised standards, VENICE HOLIDAY'S may ask them to vacate the house.

14. Court of Venice has exclusive jurisdiction over any claims, disputes or other matters in question between the parties.
