In Norway married couples with children under 16 years must attend mediation before they can proceed the separation or divorce case - or before they can bring a dispute about the children before a court or the County Governor. This is regulated by a change in 1993 in the Marriage Act. According to the Children Act mandatory mediation is also the case for cohabiting parents when matters of custody and access is contested. In general cohabiting parents are offered mediation when they split up, but this it is not mandatory. This new mediation represents a shift of focus from marriage to parenthood, from the divorce itself to parental post-divorce cooperation. The mediation arrangement has been thoroughly evaluated by a research program, and some major findings will be presented. |
