This
presentation consists of an overview about the ADR movement in Latin American
Countries, mostly focused on Argentina.
Several mediation and conciliation programs, are described mentioning
the not only who is carrying them out but who is sponsoring and supporting
the endeavors.
The paper refers to the countries in which legal regulations have been
passed. It includes comments and an analysis focused on mediation and
conciliation, even though some times arbitration is considered as the
most important ADR mechanism.
The first Interamerican ADR Conferences held in Buenos Aires 1993, Santa
Cruz de la Sierra, Bolivia, 1995 and San José de Costa Rica, 1997
directed by Fundación Libra, sponsored by the National Center for
State Courts, the Agency of United States International Development, among
others, are identified as the starting point of the Latin-American and
Caribbean movements.
The history of the Argentine National Mediation Plan is explained together
with the Pretrial Mediation and Labor Conciliation Acts. Some other ADR
developments are included.
The ten year lessons allow us to pave the way for the movement's growth
and for the best accomplishment of our goals.
