No se ha escuchado aún, es cierto. Pero nadie dirá que no
sería posible que alguien imagine el proceso de mediación
como una variante de psicoterapia. Seguramente no habría de ser
yo.
Sin embargo, la práctica psicoterapéutica ha permitido una
aguda mirada respecto de nuestra condición humana y de los determinantes
del sufrimiento y del dolor. Y de los determinantes del goce y el amor.
No sólo no podemos decir que esos aspectos pasan a ser meros efectos
subsidiarios y molestos para una verdadera negociación en regla,
sino que son la salsa y el estofado de nuestros guisos, o de los desaguisados
que acontecen en prácticamente cualquier situación que requiera
de un tercero para saldar diferencias que se representan imposibles para
los sujetos en pugna.
Pero esto no lo saben sólo los psicólogos. Lo tiene claro
el ingeniero agrónoma, la maestra y la vecina, Doña Rosa
. Lo sabe el juez, el contador y el empresario.
Pues entonces, ¿porque no darle letra?
A fin de cuentas, son estas ideas las que no sólo me permitieron
sino que me condujeron en el tránsito de acercamiento y compromiso
con el campo de la resolución de conflictos y la mediación.
Yo he trabajado estas ideas con colegas de diversas profesiones y oficios
y creo no sólo haberme hecho entender, sino que la apropiación
de las mismas ha enriquecido la perspectiva de los mismos. Recientemente
estudiantes, profesores, policías, algunos mexicanos, otros navajos,
algunos mas propiamente anglosaxon, en la New Mexico University, me han
acompañado en el pensamiento: reconociendo que algunas ideas ya
las venían tramando de diversos modos y en diversos momentos de
su existencia.
Entonces, la idea de una mesa redonda será compartir estos saberes
en su diversidad, y pensar en los esperables aportes que se puedan producir
en la cualificación que nos preocupa en tanto mediadores. Para
ello habré desarrollar algunas ideas centrales que se despliegan
mas extensamente a continuación.

Las personas disputan acerca de cosas fundamentales para sus vidas. Un
observador externo podría asombrarse de la trivialidad o de la
insignificancia de lo que está en juego, comparado con la pasión
desplegada.
No obstante, en todo conflicto significativo para sus intervinientes,
la fuerza de los argumentos, la desesperación, el odio y la obcecación
indican que se juega allí algo de mucha importancia, seguramente
mayor de la que los contendientes suponen. A veces, da la impresión
y de hecho acontece, que se juegan la vida. Se matan por el objeto de
la disputa. Su reclamo puede tener tal magnitud, que el objeto representa
lo esencial en sus vidas, y por ello se puede incluso dar la vida, o quitarla.
Pero nuestro observador externo insiste con su mirada asombrada y conjetura
que no puede ser que se trate de eso, sino que más bien la disputa
debe tener su raíz y su sentido en otro lado.
Desde temprano, la mirada de la mediación sobre el conflicto se
basó en considerar una división en el sujeto de la disputa
misma, y no solamente entre los contendientes. Esa premisa fue fundamental
para abrir un campo de praxis novedosa, que contra todas las apariencias,
no se apoyaba en nada obvio y evidente, en ninguna naturalidad de los
fenómenos humanos. O sea, no era una cuestión solamente
de sentido común y de practicidad simplemente porque las mediaciones
funcionaban.
Habría un concepto teórico. Como todo concepto,
operaba en un par opositivo que fue denominado: posición/interés.
La fuerza de este concepto permitió desplegar el campo de la mediación
a condición de que los mediadores lo concibieran como rector de
su acción. Correlativamente, los mismos debían también
reconocer la medida de su intervención: debían ser neutrales.
Al aceptar que las posiciones sostienen el argumento de la confrontación
de dos sujetos, la no adhesión del mediador a las mismas permitiría
pasar a una segunda confrontación: de los sujetos consigo mismos.
La diferencia entre su posición respecto de sus intereses, los
habría de llevar a una reformulación del conflicto. Notablemente,
el conflicto habría de pasar a ser tratado y resuelto en el plano
de las palabras y no en el de las acciones respecto de las cosas: imposiciones
de poder o el irse a las manos.
Este presunto "ascenso" se haría posible en tanto el
tercero no sumara su propia posición (convicción, principios,
preferencias, todas ellas mas o menos conscientes, mas o menos desconocidas
en sus reales motivaciones), ni desplegara su poder hacia la posición
de alguno de los contendientes. Este poder se reduciría a posibilitar
ese pasaje de posición a interés en la conciencia de los
sujetos, con la premisa de que es a partir de allí que, y a diferencia
de la "solidez de las cosas", la dimensión de la palabra
permitiría dialectizar los términos, interrogar las actitudes
y necesidades, y sobre todo multiplicar las perspectivas respecto de lo
que está en discusión al reformular los términos
del conflicto.
Todo ello para descubrir que lo que aparecía como la puerta única
para entrar se transforma en una multitud de puertas posibles para salir.
Ninguna la fundamental, varias serían las posibles, alguna más
conveniente Pero por ninguna se iría la vida. Por el contrario,
se habría de reducir la dimensión tanática del choque
y la controversia, y podría resurgir una fuerza vital que ya se
daba por perdida. En otras palabras, la satisfacción del mediador
en la eficacia de su función, es que habría permitido a
los sujetos de la disputa, una transición de un lugar a otro: un
trabajo de cada uno y entre sí. Ello sólo sería posible
debido a que su función de terceridad remite a y convoca una dimensión
simbólica.
Era entonces evidente que entre posición/interés y neutralidad
debía haber una relación interior, pero esta no podía
pasar solamente por su funcionalidad: que sea efectiva y produzca resultados.
Como toda apertura de un campo novedoso, los conceptos implícitos
puestos a prueba, permitirían en un segundo momento retornar a
descubrirlos...nuevamente, y entonces se podría pensar que una
teoría puede fundar el sentido de una práctica. Solamente
así se podría entender que ello sea transmisible a otros:
o sea, que se pueda enseñar y transformar en una práctica
social.
Retomando, se observa que la confrontación entre los sujetos parte
de la premisa que algo que el otro tiene, algo de lo que priva o representa,
es fundamental para la vida del primero. Mas aún, que ello es la
causa y razón de su infortunio, por lo que solamente su posesión
o el tener la razón que se imponga al otro, podría satisfacerlo.
Esto se puede ilustrar en el relato de un abogado respecto de un juicio
de divorcio donde el hombre resentido (y seguramente tenía sus
motivos, como siempre) trataba de despojar de todo lo posible a su ex
cónyuge. Logrado lo cual, y ya finalizado el juicio, manifiesta
que en realidad no quería todo lo obtenido, y más aún,
que no era lo que quería. El malestar del abogado era compartido
por varios abogados que lo escuchaban: a todos les había pasado
algo similar. Se preguntaban: ¿qué quería entonces
el hombre? Descubríamos que ahí radicaba la esencia de la
mediación: percibir que no eran las cosas por sí mismas
lo que se está disputando.
Enfoquemos nuestra mirada hacia esta perspectiva, en donde lo fundamental
estaría en el lugar del otro. Tal vez el amor tenga su amarra en
eso. Pero lo tiene el odio también. Si el otro tiene lo que es
fundamental para el ser, se lo debería obtener, arrancar y apropiar
a cualquier precio. También puede evitar soportar la afrenta de
esa diferencia insoportable, destruyendo al objeto. Ninguno habría
de tenerlo, aún a costa de perderlo, aún a costa de destruir
también al otro. Que es un modo de decir que pierde el primero
también: la confrontación es en espejo . Notablemente, el
odio en eso no tendría miramientos, y asegura una adhesión
al otro con amarras que los encadenan en una "captura imaginaria"
de la cual no se pueden desprender... y tampoco quieren. El otro deja
de ser un sujeto, para ser un mero objeto carente de humanidad. Es interesante
notar que las diversas modalidades de mediación no dejan de aseverar
la importancia de reconocer al otro en su singularidad: en lo que quiere,
piensa y siente. Sentarlos uno junto al otro, verse, tomar y dar consistencia
humana. Escucharse. Cuando se puede.
Pero en la disputa, todos se gritan y escasamente se escuchan en serio.
Eso se debe a que cada cual está comprometido en la consistencia
de su ser: se juega, al parecer, la vida. Observamos la aparición
del objeto como un "todo", indiviso y sin equivalencias que
permitan la sustitución de una cosa por otra (y por ello no sería
simbólico). Esto se sostiene "absolutamente" en la trivialidad
de argumentos parciales, consistentes en su argumentación pero
incompletos respecto de la realidad que pretenden cernir; o inconsistentes
en el despliegue de sus razones, pretendiendo alumbrar una verdad total.
En la aspiración de abarcarlo todo, no se supera lo inconciliable
de la contradicción, apreciada tempranamente en el universo de
la lógica: "la verdad se dice a medias", pues la otra
mitad es su negación, o sea lo falso. Siempre posible, es a la
luz del par opositivo verdad/falso por el que se sostiene cualquier argumentación
lógica. Se aprecia esto en la frase usual: "Todo el 'objeto'
es para mí, y 'nada' para el otro, Tengo 'toda' la razón
y el otro 'nada' que merezca ser siquiera escuchado.
Demanda absoluta, que excluye la presencia de otras posibilidades y por
supuesto el mediador para el caso, no tendría chance de ser sino
un instrumento que debiera sostener la razón de uno o del otro,
de uno sobre el otro.
¿Cuál sería entonces la función del mediador?
Reducir la dimensión de una 'demanda absoluta' que se sostiene
en las 'posiciones' desplegadas y argumentadas, para que los sujetos de
la disputa puedan interrogarse respecto de qué es lo que quieren.
A eso en negociación se lo ha denominado 'interés', y en
el campo del psicoanálisis, cuando se interroga lo que un sujeto
quiere, mas allá de las conformaciones en que ordena el despliegue
de sus demandas, sostenidas en sus representaciones imaginadas respecto
del otro, se lo denomina 'deseo'. En otras palabras, la pregunta pasa
a ser si quiere aquello que desea, y entonces: ¿Cómo?, ¿cuando?,
¿De quién?,¿ con quién?, etc.
Se ve que en una afirmación tal, se presenta la esencia de una
paradoja, o de una división subjetiva. Hacia allí debe ir
el mediador. Por ello la importancia de la pregunta en sus intervenciones.
Antes de concluir en la naturalidad y evidencia de las aspiraciones y
convicciones de los sujetos en juego, siempre e inevitablemente comparadas
a las propias, que no son de un mayor grado de 'realidad', su función
simbólica intenta llevar a que los sujetos se interroguen. En la
dualidad de la confrontación, su lugar estaría signado por
ser el tercero: pero no por ser representante de un saber superior y superador,
ya que no es un banal predicador de almas, sino que simplemente incorpora
a la especularidad de la disputa otra dimensión: la simbólica,
en otras palabras, la cultura, que en su máxima condensación
se enuncia al comienzo, con las palabras de Maimónides.
Representa la incapacidad de satisfacer totalmente el deseo humano, debido
no solamente a la condición de insuficiencia con que el humano
entra a este mundo, requiriendo tanta asistencia y cuidado de los genitores,
sino que también porque no tiene asegurado el objeto que le procura
la 'felicidad'. Esa insuficiencia le impone estar sometido a los avatares
del destino, sin tener garantías. Como dice Amelia Biaggioni:
"Es imposible construir un hombre, siempre falta lo fundamental"
Eso fundamental, que haría del hombre algo total y completo, carente
de contradicción, le plantea las más difíciles alternativas.
Tal vez, una de las mas duras de soportar, es aquella que en la letra
del grupo rockero La Renga, se enuncia así:
"La muerte siempre triunfa, y por ello es que te da toda una vida
de ventaja"
Pero se puede enunciar la misma idea de otra manera, tal como lo hace
una definición de economía que enunciaba el siguiente dilema
sin solución: respecto de demandas infinitas, sólo se puede
responder con recursos finitos. La demanda infinita es respecto de un
objeto, innombrable, el que hace falta. Al fin de cuentas, ¿cuál
es? y sin embargo aparece como el motor de todo. Posiblemente, como se
piensa en psicoanálisis, ese obscuro objeto del deseo, no sea sino
aquello que pone en marcha las cosas.
Sólo habría posibilidad de dirigir nuestros pasos hacia
algún lugar en tanto procuremos algo imposible de lograr. Si ello
fuera obtenible, si ello fuera representable razonablemente en los paraísos
y utopías que la historia y las religiones han sugerido en sus
diversas acepciones, donde la ausencia de toda necesidad garantizaría
la paz entre las almas, veríamos que la falta de deseo, ya que
todo se satisface, no solo haría la vida sumamente aburrida, sino
que no tendría sentido alguno. En otras palabras, para bajar a
una trivialidad, completar la colección de estampillas es decepcionante,
nada mejor que la excitación de tratar de obtener la estampilla
imposible, y perder el aliento al hallar la inhallable. Si completamos
el álbum, no nos queda otra chance que soportar la decepción
y buscar de vuelta en otro lado. Algo habremos de encontrar.
En eso consiste la función del mediador, y que había percibido
nuestro abogado con tanta nitidez: cuando obtienes todo lo que quieres,
no era lo que querías, era otra cosa. Asegurar que siempre es otra
cosa, es lo que debiera suceder en mediación. Que alguien pueda
imaginar que hay mas opciones en su vida que aquella que lo enceguece,
es también dar lugar a que pueda seguir deseando.
Debe también entenderse , que la mediación no es ni debiera
imaginarse como una panacea. No solamente se deben excluir una diversidad
de problemáticas que deben tener otros canales de solución
o de impasse, sino que además en determinadas ocasiones, hay quienes
no pueden o no quieren tomar la mediación como alternativa. No
solamente por la evolución o el momento del conflicto, o sus circunstancias
personales, sino por algo de otra envergadura.
En la ópera "Jovanchina" de Modest Musorgski un severo
pastor luterano afirma con la lucidez del texto del guionista, diciendo
palabras que me apuré en registrar en la oscuridad de la sala,
en una secreta complicidad con el bajo que las cantaba:
"El infierno fue creado para contener tanta ira" .
Esas palabras me han dado la medida de la intervención del mediador.
¿Qué podría hacer un sujeto sin ese infierno? En
otras palabras, ¿porque habría se lo habría de sustraer
de allí? ¿Sabrá qué hacer con su ira?
El mediador y su intervención no pueden dar respuesta ni asumir
esa responsabilidad, y por ello, es necesario que los sujetos de la disputa
estén convencidos que la mediación es lo que quieren para
salir de 'su ' infierno. Ellos deben saberlo, en eso consiste el 'empowerment'
de Baruch Bush y la 'autonomía' que propone el Standard de Conducta
de SPIDR (Sociedad de Profesionales en Resolución de Disputas)
y otros.
Ellos deben saberlo, y también los mediadores, cuando tratan de
saber qué dicen cuando enuncian la neutralidad.
El resto, es como dice Roger Caillois en Los juegos y los Hombres:
"Todo juego es un sistema de reglas.
Nada mantiene las reglas sino el deseo de jugar."

People dispute about fundamental things for their lives. An external observer
could astonish himself with the triviality or the insignificance of what
is in play. compared with the passion layed out. Notwithstanding, in every
significant conflict for the people taking part of it, the strength of the
arguments, the desperation, the hate and the obfuscation indicate that what
is in dance is something very important, probably more than what the contenders
suppose.
Sometimes one has the impression , and in fact it happens, that they are
even putting in risk their own lives. They kill themselves for the object
of the dispute. Their demand can have such a magnitude, that the object
can represent the essential in their lives, and for that , one can give
his life, or take it from the opponent. But our external observer insists
with his astonished glance, and conjectures that that cannot be all, and
that the dsipute must have its roots and it' sense somewhere else.
Since early times, the sight of mediation on the conflict based itself in
the oconsideration of a division in the subject of the dispute, and not
only between the contenders.. That premise was fundamental to open a new
field of practice, and against every appearance, wasn't based in anything
obvious or evident, in any naturality of the human phenomenon. It wasn't
only a matter of common sense and practicity, simply because the mediation
worked.
There was a theorical concept. As any concept, it operated in an opositive
pair that is denominated: position/interest. The strength of this concept
permitted the unfolding of the field of mediation with one condition: the
mediator's acceptance of this concept as a rector for action. Correlatively,
they had to accept the meassure of their interventions: one had to be neutral.
If we accept that the positions sustain the argument of the confrontaiton
of two subjects, the non adherence of the mediator to these positions pemits
them to pass to a second confrontation: of the subjects with themselves.
The difference between their position respect of their interests, would
enable the reformulation of the conflict.
Notably, the conflict would then pass to be treated and solved in the plane
of words and not in that of action respect of the objects: the impossing
power or laying hands on. This pressumed "ascence" is only made
possible if the third one doen't add his own position ( convictions, principles,
prefferences , all of them more or less conscious, more or less ignored
in their real motivations), nor does he display his power towards the position
of any of the contenders.
This power would be reduced to carry out the passage from position to interest
in the conscience of the subjects, with the premise that it is from there,
and different from the "solidity of things", That the dimension
of words shall permit the dialectization of the terms, the interrogation
of attitudes and needs, and overall, multiply the perspectives respect of
what is being discussed, by reformulating the terms of the conflict. All
to discover that what seemed to be the only door in, was transformed in
a multiplicity of possible doors out.
None is fundamental, several are possible, some is more convenient. But
by none life walks out. In the contrary, the tanatic dimention of collission
and controversy is reduced.
A new vital force may spring up again , which had been supposed lost. In
other words, the satisfaction and joice of the mediator in the efficacy
of his function, consists in that he made it possible for the subjects in
a dispute, a transition from one place to another: a work of each one and
between them. That is only possible since is function is simbolic.
It was then evident that between position/ interest and neutrality there
had to be an interior relation, but that it shouldn't happen only because
of its functionality: effectiveness and results. As in the opening of any
new field, the implicit concepts on trial, allow in a second moment to discover
them...once again, and it is only then that we can think that a theory may
sustain the meaning of a practice. It is only in this way that we can consider
it being transmissible to others. In other words, that it can be taught
and be transformed in a social practice.
The confrontation between subjects part from the premise that something
the other one has, or represents, is fundamental for the life of the first
one. More even, that it is the cause of his misfortune. So that only its
possession or having the reason that imposes itself on the other one can
bring satisfaction. This can be illustrated with the anecdote I heard told
by a lawyer respect of a divorce, in which the resented man tried to dispossess
his ex-spouse of everything possible . Once he obtained this, and the litigation
ended, he told his advocate that he really didn't want what they had obtained,
and that in fact, it wasn't what he desired. The bad feeling of the lawyer
was shared with the other lawyers that were hearing him: all had experienced
something similar. They asked themselves: What did this man desire? We discovered
that there radicated the essence of mediation: the perception that it isn't
the things by themselves what are being disputed.
Let's focus our sight on the other side: in the place of the other one,
where the fundamental seems to be. Maybe love has its mooring in this. But
hate has it too. If the other one has the fundamental for my being, I have
to obtain it, rip it off him and appropiate it at all cost. One can also
avoid tolerating the affront of this unfavourable difference, destructing
the object. No one shall have it, even at the price of loosing it, even
at the price of also destroying the other one. It's a way of saying that
the first one will also loose: the confrontation is reflexive as in a mirror.
Notably, hate has no consideration, and enssures the adherence to each other
with a mooring that enchains them in an "imaginary capture" of
which they cannot loose themselves... and then , neither do they want to.
The other one stops being a human subject, to become a mere object lacking
any humanity.
It's interesting to observe that the diverse modalities of mediation emphasize
the importance of recognizing the other one in his singularity: in what
he wants, thinks and feels. Sit them one beside the other, to see each other,
to take and give human consistence. To hear each other.
But in the dispute everybody shouts to each other, and scarcely hear themselves
seriously. That is because each one is compromised with the consistency
of his own being: they risk, it seems,. their own lives. We observe the
apparition of the object as a "whole", undivided and without equivalences
that might enable the substitution of one thing by another ( and that is
why it isn't symbolic). This is "absolute "substained in the triviality
of partial arguments, consistent in their argumentation but incomplete respect
of the reality they pretends to sift; or inconsistent in the unfolding of
their reasons, because in the pretension of comprising the whole, they cannot
overcome the irreconcilable of contradiction. That was early appreciated
in the universe of logic: "truth is only half said " because the
other half is its negation: falsity. Always posible , it is within the oppositive
pair true/false, that any logical argumentation can sustain itself. We appreciate
this in the usual phrase: "All the object is for me, and nothing for
you ", "I have all the reason and you have nothing that even deserves
to be heard". An absolute demand, that excludes the presence of any
other possibility, The mediator then, has no other chance than to be the
instrument that might sustain the argument of one or the other, of one over
the other.
Which would be the mediator's function? To reduce the dimension of an "absolute
demand" that sustains itself in the "positions" that are
displayed and argumented. So that the subjects of the dispute might interrogate
themselves about what is it they want. That is called "interests"
in negotiation and in the field of psychoanalysis, when a subject interrogates
himself about what he wants, farther away from the configurations in which
his demands unfurl , supported in his imaginary representations respect
of the other one, is denominated "wish" In other words, as we
have seen before, the question is if he wants what he wishes, and then:
how, when, where, from whom, with whom, etc.
One can observe in such affirmation the essence of a paradox, or a subjective
division. The mediator has to direct himself towards that side. And that's
why asking questions is so important in his interventions. Before concluding
in the naturality and evidence of somebody's aspirations and convictions
, always and inevitably compared to one's own, that haven't got a greater
degree of "reality", his symbolic function intents to lead the
parts towards interrogating themselves. In the duality of confrontation,
his place is signed by tercerity. Not because he may represent any superior
and surpassing knowledge, he is no banal soul predicator, but because he
simply incorporates to the dispute another dimention: the symbolic one.
In other words, the culture.
It represents the incapacity to satisfy completely the human wish, owing
not only to the condition of insufficiency with which the human being enters
this world, recquiring so much assistance and care from the genitors, but
also because he cannot seccure the object that might provide "happiness".
That insufficiency imposes him to be subdued to the haphazards of destiny,
without any guarantees. As Amelia Biaggioni says:
"It's impossible to build a man, the fundamental is always missing."
That fundamental, that would make a complete totality out of man, lacking
contradictions, presents the most difficult alternatives. Maybe one of the
most difficult to bear, is expressed in the text of a song of a popular
rock group: "La Renga"( The Lame), that says:
"Death always triumphs, and that's why it gives you a whole life of
advantage".
But this idea cen be ennounced in still another way, such as is done by
a definition of economy that poses the following dilema without solution:
"Respect of infinite demands, one can only respond with finite resources".
Infinite demands is respect an unnameable object, the one that is necessary.
But finally, which is it? and nevertheless it appears as the motor of everything.
Possibly, as it is thought in psychoanalysis, that obscure object of desire,
might not be anything else than what makes everything go. The only chance
to lead our steps anywhere is if we procure something impossible to be attained.
If it might be obtainable , if it were reasonably representable in the paradises
and uthopies that history and religion suggestin its different aceptions
, where the absence of all necessity would guarantee peace between the souls,
we would see that the lack of wish, as everything is satisfied, not only
it wouldn't make any sense but also it would make our lives very boring.
In other words, descending to trivia, completing a collection of stamps
is dissapointing, Nothing better than the excitation in trying to obtain
the impossible stamp, and loosing one's breath trying to find the unfindable.
If the album is completed , we have no other chance than trying to find
something else. We'll surely find it .
In that consists the function of the mediator, that our lawyer percieved
so clearly: when you obtain all of what you want, it happens that it wasn't
what you really wanted, it was something else.
To assure thast it is always something else, is what we do in mediation.
That somebody may imagine that there are other options in his life than
the one that blinds him, is also giving place to the possiblity to continue
wishing.
But we also have to understand that mediation isn't and shouldn't be a "panacea".
Not only does it have to exclude a diversity of problematics that should
have other channels of resolution or of impasse, but also there are people
who cannot or don't want to take mediation as an alternative. Not only because
of the evolution or the moment of the conflict, or their personal circumstances,
but because of something of a bigger dimension.
In the opera Jovanchina of Modest Musorgski, a severe lutheran priest affirms
with the lucid text of the script writer, some words that I hurried to write
in the obscurity of the theatre, in a secret complicity with the bass that
was singing them:
"Hell was created to contain so much wrath".
Those words gave me the meassure of the intervention of the mediator. What
could a subjct do without that hell? In other words, why should we withdraw
him from trhere? Would he know what to do with his rage?
The mediator and his intervention cannot give an answer to that or assume
such a responsability, and that is why it's necessary that the subjects
of the dispute be convinced that mediation is what they want to walk out
of 'their'hell. They should know it, in that consists the 'empowerment'
of Baruch Bush, and the 'autonomy' stated by the rules of conduct of SPIDR
and others.
They have to know it, and also us mediators when we try know what we are
saying when we speak about 'neutrality'
